Terms of Service

By accessing or using the MagicBNB website (magicbnb.io), the MagicBNB web application (app.magicbnb.io), or any related services (collectively, the "Service"), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Service.

These Terms apply to all visitors, registered users, and subscribers. By creating an account or using the Service, you represent that you are at least 18 years of age. If you use the Service on behalf of an entity, you represent you have authority to bind that entity to these Terms.

MagicBNB provides a software-as-a-service (SaaS) platform for short-term rental hosts and property managers. The Service includes:

Portfolio Analytics — Real-time dashboards, true operator profit metrics, revenue and expense tracking, occupancy analysis, YoY/MoM/QoQ comparisons, and property profitability rankings.

Integrations — Secure connections to property management systems (Hospitable, Hostfully), bank accounts (via Plaid), and booking channel data (Airbnb, Vrbo, direct).

Deal Analyzer — Pre-purchase and pre-lease financial modeling tools for projecting revenue, ROI, break-even occupancy, and startup costs.

Milo AI — An AI assistant with access to your portfolio data that answers questions and assists with analysis. Milo outputs are informational only and do not constitute financial, legal, investment, or tax advice.

Reports — Automated P&L statements, owner statements, monthly portfolio reports, and PDF exports.

MagicBNB is a business intelligence tool. It is not a PMS, booking engine, accounting platform, or licensed financial advisory service.

To access most features, you must register for an account. You agree to provide accurate information, keep it updated, and maintain the confidentiality of your password. You are responsible for all activity under your account.

Notify us immediately at legal@magicbnb.io if you suspect unauthorized access. You may not share credentials with third parties, create multiple accounts, or misrepresent your identity.

MagicBNB may suspend or terminate accounts that violate these Terms or pose a risk to the Service. You are responsible for ensuring your use complies with all applicable laws, including STR regulations in your jurisdiction.

Free Trial. MagicBNB offers a 14-day free trial with no credit card required. At the end of the trial, you must subscribe to a paid plan to continue using the Service.

Subscription Plans. The current Pro Plan is $20/month for up to 3 property listings, plus $7/month per additional listing. Pricing may change with 30 days' notice.

Billing. Subscriptions are billed monthly via Stripe, Inc. By subscribing, you authorize recurring charges to your payment method. You are responsible for keeping payment information current.

Taxes. Subscription fees exclude applicable taxes. You are responsible for all applicable sales tax, VAT, or GST in your jurisdiction.

Failed Payments. If payment fails, we may suspend access until the balance is resolved.

Refunds. All fees are non-refundable except as required by law. Cancellation takes effect at the end of the current billing cycle; no prorated refunds are issued.

Cancellation. You may cancel anytime via account settings or by contacting legal@magicbnb.io.

Property Management Systems (Hospitable, Hostfully). When you connect your PMS, you authorize MagicBNB to access your listing, reservation, and booking data via the PMS's official API using OAuth or API key authentication. MagicBNB never stores your PMS password. You may revoke access at any time.

Bank Connections (Plaid). Bank connections are handled by Plaid Technologies, Inc. By connecting your bank, you agree to Plaid's End User Privacy Policy (plaid.com/legal). MagicBNB receives read-only access to transactions and balances — we cannot initiate transactions on your behalf.

Booking Channels (Airbnb, Vrbo, Direct). Booking data is imported via your connected PMS. MagicBNB has no direct relationship with Airbnb or Vrbo and is not affiliated with or endorsed by those platforms.

Payment Processing (Stripe). Subscriptions are processed by Stripe, Inc. (stripe.com/legal). MagicBNB does not store your full credit card number.

Third-party integrations depend on those parties' continued availability. MagicBNB is not responsible for disruptions caused by changes to third-party services. You are responsible for complying with the terms of any connected third-party platform.

Ownership. You retain all ownership of data you input or import ("Your Data"). You grant MagicBNB a limited license to process Your Data solely to provide the Service.

Accuracy. You are solely responsible for the accuracy of Your Data. Inaccuracies in your PMS, bank data, or manual entries will result in inaccurate Service outputs.

AI Interactions. Messages to Milo are processed by AI systems. Outputs may contain errors and should not be relied upon as professional advice.

Data Portability. You may export Your Data at any time. Upon termination, you may request a copy within 30 days, after which we may delete it per our retention policy.

Prohibited Data. You may not submit data you don't have rights to use, that infringes third-party IP rights, or that constitutes unnecessary third-party PII.

You agree not to: violate any applicable law; attempt unauthorized access to the Service or related systems; introduce malware or malicious code; scrape or data-mine the Service using automated tools; interfere with Service integrity or performance; reverse engineer or decompile the Service; use the Service to build competing products; impersonate any person or entity; send spam or automated requests; or circumvent access controls or rate limits.

Violation of these restrictions may result in immediate account suspension or termination.

MagicBNB Intellectual Property. The Service — including software, algorithms, UI designs, text, graphics, logos, and code — is the exclusive property of MagicBNB and its licensors, protected by applicable IP laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service per these Terms.

Restrictions. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service, nor remove proprietary notices.

Trademarks. "MagicBNB," "Milo," and related marks are trademarks of MagicBNB. No right to use them is granted without prior written consent.

Feedback. Any feedback you provide grants MagicBNB a perpetual, royalty-free license to use it for any purpose.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. MAGICBNB DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.

No Financial or Professional Advice. Nothing in the Service — including Milo outputs, deal analyses, projections, ROI calculations, or reports — constitutes financial, investment, legal, or tax advice. All outputs are informational only. Consult a qualified professional before making any financial or legal decision.

Third-Party Data. We are not responsible for accuracy, completeness, or timeliness of data provided by your PMS, bank, or booking channels.

AI Limitations. Milo's responses are AI-generated and may contain errors. Verify all AI outputs independently before relying on them.

Projections. Revenue projections and deal analyses are estimates based on your inputs. Actual results may differ materially. Past performance is not indicative of future results.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGICBNB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

MAGICBNB'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO MAGICBNB IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain liability exclusions. In those jurisdictions, MagicBNB's liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless MagicBNB and its affiliates, employees, agents, officers, and directors from any claims, liabilities, damages, losses, costs, and fees (including attorneys' fees) arising from: your violation of these Terms; your use or misuse of the Service; Your Data; your violation of any third-party right; your violation of any applicable law; or any misrepresentation by you.

This obligation survives termination of these Terms.

Termination by You. Cancel anytime via account settings or by emailing legal@magicbnb.io. You retain access through the end of your billing period.

Termination by MagicBNB. We may suspend or terminate your account at any time for violations of these Terms, non-payment, harmful conduct, extended inactivity, or legal requirements.

Effect of Termination. Upon termination, your license ends immediately. We may delete Your Data after a reasonable retention period. Provisions that by nature should survive termination — including disclaimers, IP rights, indemnification, and liability limitations — will survive.

Governing Law. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Informal Resolution. Before any formal dispute, contact us at legal@magicbnb.io and attempt informal resolution for 30 days.

Arbitration. Unresolved disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, in Delaware (or remotely by agreement). The arbitrator's decision is final.

Class Action Waiver. You waive any right to participate in class action, collective action, or representative proceedings against MagicBNB.

Exceptions. Either party may seek injunctive relief in any court of competent jurisdiction to protect IP rights or prevent irreparable harm.

We may modify these Terms at any time. For material changes, we will update the Effective Date, notify you by email at least 14 days before changes take effect, and display a notice in the Service.

Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you disagree, you must stop using the Service. The current version is always at https://magicbnb.io/terms.

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and MagicBNB regarding the Service.

Severability. If any provision is unenforceable, it will be modified to the minimum necessary, and remaining provisions remain in effect.

Waiver. Failure to enforce any right or provision is not a waiver of that right.

Assignment. You may not assign your rights without our written consent. MagicBNB may assign its rights without restriction.

Force Majeure. MagicBNB is not liable for failures due to causes beyond our reasonable control, including natural disasters, internet outages, or third-party service failures.
